Terms of Use

These Terms of Use govern your access to and use of nestingtree.in and every page, form and file on it (the "site"). The site is published by Nesting Tree ("we", "us", "our"). By browsing the site, or by submitting an enquiry through it, you accept these terms in full. If you do not accept them, please stop using the site.

1. Who publishes this site, and who may use it

This website is published by Nesting Tree, a residential developer operating in Navi Mumbai & Panvel. It exists to describe our residences and to let you enquire about them.

By using the site you confirm that you are at least 18 years old and competent to contract under the Indian Contract Act, 1872, and that if you are using the site for a company, firm or other body, you are authorised to accept these terms for it. This site is not intended for children, and the enquiry forms must not be used by anyone under 18.

2. What this site is — and what it is not

The site is an informational and promotional publication about our projects. It is not a sales platform, a booking system or a payment channel.

Nothing on this site — no page, image, plan, figure, statement, caption or communication generated from it — constitutes an offer, an invitation to offer, a proposal within the meaning of the Indian Contract Act, 1872, a prospectus, a warranty, a reservation, an allotment, or a contract of any kind. No legal relationship of buyer and seller is created by your use of this site.

3. Project information is indicative

This is the most important thing on this page, so it is stated plainly:

• Elevations, renders, walkthroughs, 3D views and interior images are artistic impressions, not photographs of a finished building, unless expressly captioned as site photography. Furniture, fittings, appliances, décor, landscaping, vehicles, people and surroundings shown in them are for illustration only and do not form part of any home.
• Floor plans, layouts, dimensions, carpet areas, built-up areas, unit counts, unit numbering and floor numbering are indicative and not to scale, and may change during design, construction or on the direction of the sanctioning authority.
• Specifications, amenities, finishes, fixtures, brands and materials are our current intent and may be substituted with items of similar or better quality.
• Possession dates, completion timelines and construction-progress descriptions are estimates based on current expectations. They are not commitments and are not a guarantee of any date.
• Location descriptions, maps, distances, travel times, neighbourhood and infrastructure references are approximate, drawn from publicly available sources, and may change. They are not a representation about any third-party development, road, station or facility, existing or proposed.
• Some photographs on this site are licensed stock images used to illustrate a mood or an idea. They are captioned as such, they do not show our buildings or our residents, and they must not be read as a depiction of any project.

4. What actually governs a purchase

The sale of any home is governed solely by the registered Agreement for Sale executed between you and us, the allotment letter, the plans and approvals sanctioned by the competent authority for that project, and the disclosures registered for that project with the real-estate regulator.

Where those documents and this website differ, those documents prevail absolutely. You agree that you will not rely on this website, or on any brochure, render, figure, advertisement, verbal statement or social-media post, as the basis for any purchase decision or any payment, and that you will satisfy yourself independently — by inspecting the sanctioned plans, the title documents, the approvals and the registered disclosures, and by taking your own legal and financial advice — before committing to anything.

5. Regulatory status

Not every project shown here is registered under MahaRERA. Where a project is registered, its registration number is shown on that project's own page; where it is not, the approvals it does hold are stated instead. Please check the status of the specific project you are interested in and verify it yourself on the MahaRERA portal, rather than assuming it from any other project on this site. A project that has not been registered is not being offered for sale, and no booking, payment or allotment may be made in respect of it.

6. No prices, no payments, and a fraud warning

We do not quote prices, accept bookings, or collect any money through this website. There is no payment gateway on this site and there never will be one without it being obvious.

We accept no responsibility or liability for any payment you make to any person or account we have not named to you in writing, or for any loss arising from a fraudulent, impersonating or "look-alike" website, listing, advertisement, social-media page, email address or phone number that is not ours. If anything looks doubtful, contact us before you pay, not after.

7. Who can speak for us

Only our authorised personnel, communicating in writing from our official email domain or on our letterhead, can make a representation that binds us. We are not bound by, and accept no liability for, anything said or promised by a channel partner, broker, agent, property portal, aggregator, listing site, contractor, consultant, or any person holding themselves out as connected with us, unless we have confirmed it in writing.

Listings of our projects on third-party property portals are not published or verified by us, and the prices, areas, availability, images and possession dates shown on them may be wrong. Treat only this site and our written communications as ours.

8. No professional advice, and no assurance of returns

Nothing on this site is legal, financial, tax, investment or valuation advice, and it must not be relied on as such. We make no representation and give no assurance about the future value, price appreciation, rental yield, resale prospects or investment performance of any home or of real estate generally. Any decision you take is your own, and you should take independent professional advice before taking it.

9. Testimonials, reviews and third-party content

Testimonials on this site are the personal experiences and opinions of the individuals named, published with their permission. They are not a representation by us, they are not typical or guaranteed, and they are not a promise that anyone else will have the same experience. Third-party content, quotations and publicly sourced information reproduced on this site remain the responsibility of their source.

10. Enquiries

When you submit an enquiry you confirm that the details you have given are your own, are accurate and are complete, and that you are entitled to share them. You consent to us and our authorised representatives contacting you by phone, SMS, email or messaging application about the residence you asked about and about our projects generally, including where your number is registered on the National Do Not Call registry or any equivalent preference list — this consent overrides that registration for the purposes of our reply, and you may withdraw it at any time by writing to info@nestingtree.in.

How we handle those details is set out in our Privacy Policy. Submitting an enquiry creates no obligation on either side. It does not reserve, book, hold, block or allot a home, it does not entitle you to any price, unit or availability, and we may decline to respond to any enquiry without giving a reason. We are not liable for an enquiry that fails to reach us, or for a delay in responding to one.

11. Intellectual property

The Nesting Tree name, logo and marks, and all text, renders, drawings, plans, photographs, video, layout, design, code and compilation on this site, are owned by us or used under licence, and are protected by the Copyright Act, 1957 and the Trade Marks Act, 1999. You may view pages and print or download extracts for your own personal, non- commercial reference while considering a purchase, provided you keep all notices intact.

You may not otherwise copy, reproduce, republish, adapt, translate, distribute, sell, frame, mirror or use any part of this site for commercial purposes, or use our name or marks in any advertisement, listing or domain name, without our prior written permission. Third-party names and marks appearing on the site belong to their respective owners.

12. Acceptable use

You agree not to:

• attempt to gain unauthorised access to the site, its server, its database or any system or network connected to it, or to probe, scan or test their vulnerability;
• introduce any virus, worm, trojan, malicious code or harmful material, or otherwise interfere with, disrupt or overload the site or its infrastructure;
• use any robot, spider, scraper, crawler or automated means to access, monitor, index or copy the site or to harvest data from it, or to submit enquiries automatically or in bulk;
• submit false, misleading or fabricated enquiries, impersonate another person, or submit anyone's contact details without their authority;
• use the site to transmit anything unlawful, defamatory, obscene, abusive, infringing or otherwise objectionable;
• reverse engineer, decompile or attempt to derive the source code or structure of the site, or remove or obscure any notice on it.

Unauthorised access to or interference with a computer resource is an offence under the Information Technology Act, 2000, and we reserve the right to report it and to pursue all remedies available to us.

13. Third-party links and services

Some pages link to or load resources from third-party services, including Google Maps and Google Fonts. Those services are not controlled by us. We are not responsible for their content, availability, accuracy, security or privacy practices, and a link is not an endorsement. Your use of a third-party service is governed by that provider's own terms and privacy policy.

14. Availability, and the site as it stands

The site is provided on an "as is" and "as available" basis. We try to keep it accurate, current and available, but to the extent permitted by law we give no warranty, express or implied, that the site or any information on it is accurate, complete, current, reliable, uninterrupted, timely, error-free, secure, or free of viruses or other harmful components, or that any defect will be corrected. We may change, suspend, restrict or withdraw the site, or any content or feature on it, at any time and without notice.

15. Limitation of liability

To the fullest extent permitted by law, neither we nor our directors, employees, agents, consultants or service providers shall be liable for any loss or damage — whether in contract, tort (including negligence), statute or otherwise — arising out of or connected with your access to, use of, or inability to use this site, or your reliance on any information published on it. This includes, without limitation, indirect, incidental, special, punitive or consequential loss, and loss of profit, revenue, opportunity, goodwill, business, anticipated saving or data, whether or not foreseeable and whether or not we were advised of the possibility.

It also includes loss arising from: any inaccuracy, omission or change in the information published here; any interruption, delay, defect, transmission error or unavailability of the site; any virus or malicious code transmitted through the site or a linked service; any unauthorised access to, or alteration of, data in transit; any act or omission of a third party, including a broker, portal, hosting provider or linked service; and any payment made to a person or account we have not named to you in writing.

Where liability cannot be excluded, our total aggregate liability to you for all claims arising out of or connected with the site is limited to Rs. 1,000 (Rupees One Thousand), this site being made available to you free of charge.

16. Indemnity

You agree to indemnify and hold us harmless against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the site, your infringement of any intellectual property or other right, or any false, unauthorised or third-party details you submit through the site.

17. Events outside our control

We are not liable for any failure or delay in making the site available where it is caused by something outside our reasonable control, including an act of God, flood, fire, epidemic, war, civil unrest, strike, regulatory action, power failure, network or hosting failure, or a cyber attack.

18. Suspension of access

We may restrict, suspend or terminate your access to the site at any time, without notice, if we reasonably believe you have breached these terms. The sections that by their nature should survive — including sections 11, 12, 15, 16, 21 and 22 — continue to apply afterwards.

19. Changes

We may update these terms, and the content, projects and information on the site, at any time and without notice. The date at the top of this page shows when these terms were last changed, and your continued use of the site after a change means you accept the updated terms. Please re-read this page from time to time.

20. Privacy

Our Privacy Policy explains what personal data we collect through this site, why, and what rights you have over it. It forms part of these terms.

21. General

If any provision of these terms is found to be invalid or unenforceable, the rest continues in force and the offending provision is to be read down to the minimum extent necessary. A delay or failure by us in enforcing any provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours to a successor in our business. These terms, together with the Privacy Policy, are the entire agreement between us in relation to your use of the site, and supersede any earlier understanding about it. Nothing in them creates a partnership, joint venture, agency or employment relationship. Headings are for convenience only.

22. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or with your use of this site, are governed by the laws of India. The courts at Panvel, Navi Mumbai, Maharashtra have exclusive jurisdiction, subject to any dispute-resolution mechanism prescribed by the Real Estate (Regulation and Development) Act, 2016 or by any other law that applies regardless of this clause.
